PIU Specialist in Ukrainian Administrative Law and Budgetary Procedures (PIU 4)

The "Support to the EIB APEX Agri-Food Loan Operation in Ukraine Technical Assistance Project" ("the TA" or "the project") is to facilitate the lending of the funds allocated under the European Investment Bank (EIB) Apex Agri-Food Loan Operation to Ukraine in a timely, appropriate and proper manner, assuring that all EIB and Ukrainian requirements are met. It is also to train local staff to continue the monitoring and reporting of the loan's repayment following the end of the project.

 

The Project Implementation Unit (PIU) Specialist in Administrative Law and Budgetary Procedures assists the Project and the Ministry for Development of Economy, Trade and Agriculture (MDETA) in developing needed legal and regulatory acts to ensure the successful fulfilment of the portion of the overall loan operation that is devoting to financing public infrastructure. It is anticipated that this will require developing enabling legislation and ensuring that budgetary requests from the MDETA take into account financing from the loan operation. The Specialist will also be asked to provide legal advice regarding issues arising during the preparation and processing of sub-project funding requests from (potential) final beneficiaries of the loan.

The PIU Specialist in Administrative Law and Budgetary Procedures reports to the TA Project Team Leader and works under his direction. The Specialist coordinates his activities with the Ministry for Development of Economy, Trade and Agriculture (MDETA) designated as the project's regular contacts by the MDETA Minister.

Scope of Services and Responsibilities

Activities the PIU Specialist in Administrative Law and Budgetary Procedures is expected to perform will include but not be limited to the following:

  • Assist in the design of mechanisms to ensure the fulfilment of the public infrastructure and fisheries portions of the Loan Operation
  • Ensure that all legal documents, orders, etc. concerning the PIU organization and its activities are in compliance with the legislation of Ukraine and EIB requirements
  • Prepare or assist the MDETA in preparation of all needed legal documents, orders, etc., concerning the PIU organization and its activities
  • As directed, prepare, or assist others to prepare, legal and budgetary documents regarding the Apex Agri-food Loan Operation
  • Provide legal advice to the Team Leader and the UAFATA project staff as needed
  • Cooperate with the MDETA legal department as needed
  • Cooperate with the Finance and Economic Administration of the MDETA and other concerned agencies to ensure loan for public infrastructure is properly considered and accounted for in government budgets
  • Monitor legal and national government budgetary issues of concern to UAFATA and the loan operation
  • Periodically prepare written reports to the Team Leader and MDETA contact on work done and issues encountered
  • Travel within Ukraine as requested
  • Accept and comply fully with the NIRAS code of professional ethics

Qualifications and Experience Requirements

Qualifications and skills

  • Education to at least Bachelor's degree or equivalent in law or finance
  • Possession of a valid license to practice law in Ukraine or an equivalent credential as a public finance expert
  • Native-speaker level of fluency in written and spoken Ukrainian
  • Fluency in written and spoken English sufficient to work effectively with people who do not speak Ukrainian and to understand EIB documentation and agreements written in English
  • Computer literacy (e.g. MS-Office)
  • Ukrainian citizenship

General professional experience

  • At least 5 years of work in a relevant position in a relevant agency of the Government of Ukraine
  • Experience related to the MDETA, economic actors in and the situation of the agri-food sector in Ukraine as evidenced by 5 years of relevant professional experience
  • In depth knowledge of relevant Ukrainian legislation and public finance procedures
  • Experience in a similar position in international development projects would be an advantage

Duration of the assignment

A maximum of 370 days may be allocated to the PIU Legal Specialist position over the life of the UAFATA project. The initial contract will be for six months. Continuation is dependent on fulfilment of the deliverables and continued agreement of the MDETA and UAFATA that the position continues to be appropriate, effective and needed.
